Texas Lawyer Blog – Plaintiffs sue city of South Padre Island over parking ordinance

In an Oct. 22 complaint filed in U.S. District Court for the Southern District in Brownsville, Belinda Lopez and others allege that a new parking ordinance enacted by the city of South Padre Island violates their constitutional rights. Nonprofits Texas RioGrande Legal Aid, the South Texas Civil Rights Project and Rio Legal Services represent the plaintiffs in Valley Association for Independent Living, et al v. The City of South Padre Island. In addition to Lopez, plaintiffs include the Valley Association for Independent Living, a nonprofit advocacy organization for disabled; Eduardo Cantu, a wheelchair-bound quadriplegic; and other unnamed plaintiffs similarly situated to Cantu or Lopez. The parking ordinance, which became effective in March, bars parking on streets that run east and west near a three-mile beach within the city limits from March to September each year.
